A man who tied up and raped a 20-year-old student after sneaking into her hall of residence bedroom has had his jail sentence almost doubled.
Hyung-Woo Pyo (23), of Leopold Street, Loughborough, was jailed for eight years in November after pleading guilty to rape and robbery at Leicester Crown Court.
But yesterday, a panel of three judges, led by the Lord Chief Justice, Lord Judge, said the term was "unduly lenient" and increased it to 15 years at the Court of Appeal in London.
Lord Judge said "pitiless, wicked" sex crimes committed during burglaries and robberies in the home, where people should feel safe, should be treated with the utmost seriousness. He said there should be "no room in the sentencing process for mercy."
Pyo sneaked into the student's bedroom at Loughborough University, in the early hours of the morning in May last year, initially intending to steal, the Court of Appeal heard.
But when he found her, he pounced, using duct tape to bind her wrists and cover her mouth and eyes so that she could not scream or see what was happening.
At one point, she knelt down in front of him and begged him not to hurt her, but he continued with the attack, using a mobile phone and camera to take photos of her.
He then raped her, before threatening to distribute the photos if she reported what had happened.
Pyo, a South Korean student, was arrested as he drove in his car a few days later.
At his home, police found the victim's laptop computer and a digital camera containing images of her bound and exposed. His case was back in court again yesterday after a referral for review by the Solicitor General and Harborough MP, Edward Garnier QC, on the basis that the sentence was not tough enough.
Lord Judge said the use of a digital camera to take pictures in order to effectively blackmail a victim was a "pernicious new habit" developing among criminals.
He continued: "A young woman, 20 years old, in bed in a study bedroom, falls asleep after working hard into the night, and the offender entered her room while she was alone and vulnerable.
"Asleep in her bed, he decided that he would attack her sexually.
"He bound her mouth, eyes and hands, threatened to kill her if she made a noise, took her clothes off, took photographs of her in this state and then he raped her.
"Attaching weight to the aggravating features of the case, but making allowance for the guilty plea, the sentence, following quashing of the order made by the judge, will be increased to 15 years' imprisonment."
Pyo faces automatic deportation when he has served his sentence. |
